INDIANCPMF: House Rent Allowance

I want some help in connection with free accommodation & HRA.

One of my friend was serving in CPMF and now retired on superannuation. He was posted at Delhi & for some time at Saboli & Delhi. He was keeping state pool Govt family accommodation / quarter at Delhi which he has kept till superannuation. After retirement Department has deducted 1.2 Lakhs from his gratuity as penalty of accommodation and deposited into Govt account. There was no complain from state office or any where except the Head Office action at last movement.  Their plea was that he was posted at Saboli at the border of Delhi & Haryana, where no Govt accommodation of Delhi is allowed.  Saboli is at the border of Delhi, other personnel posted Saboli are drawing 30% HRA.

He was not given any House Rent Allowance. His plea was not listen by any one even reporting to MHA & State Office.By virtue of appointment in CPMF each personnel are entitled rent free accommodation or HRA  till in service but nothing was given to him. Is it appropriate to file a case in Court for  refund the amount or HRA with cost of proceedings. Please advice
